23. Prior to the writing of the Constitution of the United States and its subsequent ratification in 1790, the fledgling government operated under the guidelines of a different document. It was known as the Articles of Confederation. Still suffering from its experiences under the strong monarchical rule imposed on the colonies during its rule by England, the authors of the Articles purposely made the central government extremely weak. They preferred instead to give the majority of the power to the smaller state governments. As a result, the Articles reserved the powers of taxation and commerce for the state governments. The Articles of Confederation also failed to provide a means of enforcement for the federal laws. There were no federal courts and many of the states viewed observation of the federal laws as voluntary.
